Update: Philip James Edward Kilby was found not guilty on 25 January 2024 following a jury trial.
A former cavalry lieutenant is accused of injuring a fellow diner at a private dinner party after throwing a bottle of champagne, a court heard.
Philip James Edward Kilby, 32, allegedly injured William Hall on January 31 last year during a gathering at a home in Fulham.
Westminster magistrates’ court heard Mr Hall suffered a gash to his forehead when shards of a smashed dinner plate flew at his face.
Prosecutor Nathan Paine Davey said Kilby “threw a bottle of champagne towards Mr Hall that hit the plate in front of him”. The shards from the plate “flew upwards and a piece cut into Mr Hall’s forehead causing a gash and him to pass out”. The court heard Mr Hall received hospital treatment and has been left with a scar on his forehead.
Nearly 21 months later, Kilby, from Taunton in Somerset, appeared in the dock on Monday to face a charge of assault occasioning actual bodily harm.
After entering a not guilty plea, he elected trial by jury and was released on unconditional bail until the next hearing at Isleworth crown court on November 22.
