Pavilion row settled out of court

A claim for £3 million in damages against Marylebone Cricket Club over a dispute involving a new pavilion at Lord's has been settled out of court.

Former commercial partners Atlantic Estates claimed in the High Court that the MCC reneged on a five-year contract to run the new Nursery pavilion and, as a consequence of that alleged action, the London-based company claimed to have lost more than £3m.

A joint statement released by Henry Lennard, of Atlantic Estates (London), says the two parties have "settled their differences' concerning the marketing and management of the pavilion".

The statement adds: "Although it was not ultimately possible for the MCC to develop the Nursery Pavilion in the way envisaged, the MCC recognises that Atlantic should be fully recompensed for the extensive work which it undertook in marketing and promoting the venue and wish to clarify that the disagreement in no way reflects upon Atlantic's achievements, abilities or expertise.

"The MCC and Atlantic have reached agreement on the amount of recompense payable to Atlantic. The MCC hopes that it will be possible to work with Atlantic on other projects in the future."

A joint spokesman for MCC and Atlantic then said: "Neither the MCC nor Atlantic will make any further comment in relation to this matter."
