Cochrane sues over plane crash

Former jockey Ray Cochrane has decided to sue Sheikh Mohammed's Godolphin racing operation and the estate of the late Patrick Mackey, the pilot whose life he attempted to save, after they were involved in a plane crash at Newmarket two years ago.

Cochrane and Frankie Dettori narrowly escaped death when their light aircraft crashed on take-off from Newmarket racecourse on 1 June 2,000. Cochrane, who is now Dettori's agent, has brought the action for personal injuries and loss of earnings.

The Derby-winning jockey alleges that by reason of his physical injuries, which included problems with his back and vision, he had to give up his profession as a jockey. Cochrane, 45, received a bravery medal for his action in pulling Dettori from the wreckage and then going back to try and save Mackey's life.

Cochrane's solicitor, Richard Brooks, explained the reason for the action. He said: "There is a two-year limitation period to claim in relation to air crashes. It is a protective measure and he had to issue it otherwise the claim would be extinguished, but Mr Cochrane has no desire to go to court and wants to settle the matter out of court."

Godolphin are not admitting responsibility and issued a statement through their solicitors in which it is stated: "While Godolphin Management Company Ltd have every sympathy with Mr Cochrane, it was not responsible for the accident and accordingly will vigorously defend the claim."

Cochrane's solicitors claim that Mackey was negligent as he should have realised that he was " insufficiently familiar with the Seneca III type of aircraft to ensure a safe take off " and his "preparation for take off in the prevailing cross-wind conditions was inadequate."
