Mr Justice Openshaw, due to preside over the criminal trial, ruled today that Janner’s death “is the end of the matter — there’s nothing more to be said.” Mr Whittam said the prosecution had considered a directive from the European Parliament and the code of practice for victims of crime and added:“However significant as both those documents are they do not provide the court with jurisdiction to proceed against a defendant who is dead.” Andrew Smith QC, defending, said he “agreed with the analysis and I have nothing further to add.”
